General Terms and Conditions
Article 1: Definitions
In these General Conditions, words—whether singular or plural—that start with a capital letter have the meanings as defined in this Article.
- 1.1 Conditions: These general terms and conditions as published on the website www.persiancaviar.ae.
- 1.2 Order procedure: The process by which the Customer places an order for a Product, whether by telephone, in person, or via the Website.
- 1.3 Customer: The natural or legal person who enters into an Agreement with Persian Caviar.
- 1.4 Contract: The agreement between Persian Caviar and the Customer, of which these General Conditions form an integral part, relating to the sale and delivery of a Product.
- 1.5 Parties: Persian Caviar and the Customer, jointly referred to.
- 1.6 Persian Caviar: The party offering the Product and applying these General Conditions; also the contracting party opposite the Customer.
- 1.7 Website: The official website of Persian Caviar, accessible at https://www.persiancaviar.ae .
- 1.8 Product: The goods offered by Persian Caviar for sale via its Website, door-to-door sales, or other channels, which the Customer may order.
Article 2: Applicability
- 2.1 These Terms and Conditions apply to all Contracts, any (email) newsletters, the Website, the Order Procedure, as well as all communications and/or (legal) acts between the Parties, even if such (legal) acts do not result in a Contract.
- 2.2 Any general terms and conditions of delivery, payment, and/or other general or specific conditions of the Customer are hereby expressly excluded and shall not apply.
Article 3: Conclusion of contract
- 3.1 The products offered on the Website, along with their listed prices, constitute a non-binding offer. The Customer may accept this offer either directly by contacting Persian Caviar, or by completing the entire Order Procedure on the Website. The Agreement may be concluded orally, in writing, or electronically. Persian Caviar will confirm the conclusion of the Agreement either in writing or by electronic means.
- 3.2 Persian Caviar does not guarantee that the product offerings and associated information on the Website are free of errors and/or omissions. Typographical or pricing errors are expressly reserved and may constitute grounds for Persian Caviar to cancel the Agreement. If Persian Caviar decides to cancel the Agreement, the Customer will be informed without delay.
- 3.3 If, for any reason—including the situation referred to in the final sentence of the previous paragraph—the Agreement is not concluded or is terminated, Persian Caviar will ensure that any amounts paid in advance by the Customer are refunded as soon as possible. Such refunds will be made within a maximum of thirty (30) days. If the situation occurs within fourteen (14) days after the Product has been shipped, the statutory right of withdrawal as set out in Article 7 and its corresponding conditions shall apply.
- 3.4 Persian Caviar reserves the right, without providing any reason, to refuse a request to enter into an Agreement or to attach additional conditions to the conclusion of the Agreement. Persian Caviar also reserves the right to amend or terminate the Agreement if the Customer fails to comply with these Terms and Conditions.
- 3.5 Persian Caviar determines the postal codes in which it offers delivery. It is possible that a Customer’s request will be declined if Persian Caviar does not deliver in the specified postal code area.
Article 4: Prices and Payment
- 4.1 All prices stated on the Website (B2C) are in AED and include VAT and any other applicable government levies. Prices also include shipping and delivery costs, unless stated otherwise.
- 4.2 Persian Caviar reserves the right to adjust its prices at any time.
- 4.3 The Customer may only use the payment methods agreed upon during the ordering process.
Article 5: Supply and delivery
- 5.1 The delivery periods stated on the Website and in confirmation emails are indicative and non-binding.
- 5.2 Persian Caviar will make every reasonable effort to meet these indicative delivery periods.
- 5.3 If and insofar Persian Caviar is unable to deliver the ordered products within sixty (60) days, the Customer has the right to cancel the Agreement, provided that Persian Caviar has been notified of the delay. Article 3.4 applies by analogy.
- 5.4 Deliveries will be made to the address specified by the Customer at the time of concluding the Agreement.
- 5.5 If, at the time of delivery, neither the Customer nor an authorized person is present or willing to accept the delivery, Persian Caviar is no longer responsible for maintaining the quality of the product from that moment onward
- 5.6 If personal handover is not possible, the delivery obligation may be fulfilled by placing the product in front of the Customer’s residence. From the moment the product is delivered in this manner, Persian Caviar is no longer responsible for the quality of the product.
- 5.7 If it is not possible to place the product directly in front of the Customer’s door, the delivery obligation is fulfilled by placing the product at the main entrance of the building. From that moment, Persian Caviar bears no further responsibility for the quality of the product.
Article 6: Complaints
- 6.1
If and to the extent that the Customer believes that the characteristics of the Product do not comply with the Contract, the Customer must promptly consult with Persian Caviar. Given that the Products are generally fresh, chilled, or frozen goods, they cannot be returned by the Customer. A complaint (reclamation) is only valid if all of the following conditions are met:
a. The Customer inspects the delivery immediately upon receipt and notifies Persian Caviar of any defects within 24hours via email;
b. The notification includes at least the Customer’s name, main delivery address, and a clear description of the defect;
c. The defective Product has not been consumed by the Customer. - 6.2 If, upon inspection, Persian Caviar determines that the Product complies with the terms of the Contract, Persian Caviar will inform the Customer and discuss the matter further if necessary.
- 6.3 If Persian Caviar determines that the Product does not comply with the Contract, the Customer is entitled to receive a replacement Product, provided that the Product is still available.
- 6.4 For the purposes of the preceding paragraph, the value of the Product shall be understood to mean the price as agreed in the Contract.
Article 7: Right of withdrawal
- 7.1 Please take note of the following information regarding the statutory right of withdrawal for consumers.
- 7.2 Exclusion of the right of withdrawal
Due to health and safety regulations under UAE Cabinet Decision No. 66 of 2023, we cannot accept returns of perishable food items (such as caviar) once delivered, unless the product is defective or incorrect.
Article 8: Force Majeure
- 8.1 In the event of force majeure, Persian Caviar is not obliged to fulfil its obligations towards the Customer. Persian Caviar is entitled to suspend its obligations for the duration of the force majeure situation.
- 8.2 Force majeure shall mean any circumstance beyond the reasonable control of Persian Caviar that prevents the full or partial performance of its obligations towards the Customer. Such circumstances include, but are not limited to: strikes, fire, disruptions in transport, operational failures, power outages, failures in (telecommunication) networks or communication systems, temporary unavailability of the Website, non-delivery or late delivery by suppliers or third parties, and the absence of any required government-issued permits or licenses.
Article 9: Processing personal data
- 9.1 If and insofar as the Customer’s personal data is processed, such processing shall only take place for the following purposes:
a. To perform and fulfil the Agreement;
b. To communicate with the Customer regarding deliveries;
c. To inform the Customer — subject to the limitation in paragraph 9.2 — about (new) products and services offered by Persian Caviar. - 9.2 The sending of commercial communications by electronic means (such as, but not limited to, email newsletters and SMS messages), as referred to in paragraph 9.1(c), shall only take place if the Customer has granted explicit permission during the Order Procedure. Persian Caviar will only send such communications if this consent has been provided.
- 9.3 The Customer has the right to access their personal data at any time, free of charge, and to request corrections of any inaccuracies.
Article 10: Applicable law, complaints and disputes
- 10.1 The Contract and any subsequent agreements shall be governed by the laws of the United Arab Emirates (UAE).
- 10.2 In the event of a complaint, the Customer may contact Persian Caviar by telephone, in writing, or via email at info@persiancaviar.ae. The contact details for this purpose are listed at the bottom of these Terms and Conditions. Persian Caviar will respond to the complaint within thirty (30) days.
Article 11: Other provisions
- 11.1 Persian Caviar reserves the right to amend these Terms and Conditions at any time. Existing agreements will continue to be governed by the version of the Terms and Conditions that was applicable at the time the agreement was concluded.
